Privacy Policy
Effective date: June 3, 2026
Introduction
Ether (“we,” “us,” or “our”) operates Ether (the “Service”), an AI-assisted workflow and delegation product available at tryether.ai. This Privacy Policy explains how we collect, use, disclose, and protect information when you use the Service, including when you authenticate with your phone number and receive text messages from us.
By using the Service, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use the Service.
Information we collect
We may collect the following information:
- Phone number. We collect your mobile phone number in E.164 format when you sign in or verify your account.
- Account and session data. Information associated with your account, authentication tokens, device or browser identifiers, and session activity needed to operate the Service.
- Messages and content. Text messages you send to or receive from our Service number, messages and instructions you submit within the product, and related metadata (such as timestamps and delivery status).
- Usage and log data. Information about how you interact with the Service, including IP address, browser type, pages or features accessed, and diagnostic logs used for security, debugging, and performance.
- Website visit counts. On our marketing site (tryether.ai), we record a simple visit count on our own servers so we know how often the site is opened. We do not use third-party advertising analytics for this.
- Early access requests. If you submit your email on our marketing site, we collect that address to respond about access.
How we use information
We use the information we collect to:
- Authenticate you, including sending one-time passcodes (OTP);
- Operate, maintain, and improve the Service;
- Send transactional SMS described in the SMS section below, including account and workflow notifications;
- Process and respond to messages you send to our Service phone number;
- Detect, prevent, and address fraud, abuse, and security issues;
- Comply with legal obligations and enforce our terms; and
- Communicate with you about the Service (for example, support responses to your requests).
SMS / Text messaging program
If you opt in, we send SMS text messages to the phone number you provide. This program is designed for transactional communication only.
Types of messages. We may send:
- Login and account verification codes (OTP);
- Transactional notifications related to tasks, workflows, or account activity you have initiated or configured; and
- Replies to messages you send to our Service phone number (two-way messaging).
No promotional SMS without separate consent. We do not send marketing or promotional text messages unless you provide separate, explicit consent for that purpose. Transactional messages are not a condition of purchasing any goods or services beyond use of the Service itself.
Frequency. Message frequency varies depending on your account activity and the actions you take in the Service. During active use you may receive multiple messages in a session; during inactive periods you may receive none.
Cost. Message and data rates may apply. Contact your wireless carrier for details about your plan.
Opt-in. Before we send your first SMS, you must affirmatively opt in by checking an unchecked consent box on our login screen and agreeing to this Privacy Policy and our Terms of Service. After signing in, you may also initiate two-way messaging by texting our Service number when it is displayed to you within the authenticated product.
Opt-out. You may opt out of SMS at any time by replying STOP to any message from us. After you send STOP, we will send a confirmation and cease SMS to that number, except where another message is required to complete an opt-out or as permitted by law. We honor carrier and industry opt-out lists.
Help. For assistance, reply HELP to any message or email us at support@tryether.ai.
No sale or sharing for third-party marketing. We do not sell or share your phone number with third parties for their marketing purposes. We do not use purchased or rented SMS recipient lists.
How we share information
We do not sell your personal information. We may share information in these circumstances:
- Service providers. Vendors that help us operate the Service, such as cloud hosting providers and SMS delivery partners (including Amazon Web Services and AWS End User Messaging for text message delivery), subject to contractual confidentiality and data protection obligations.
- Legal requirements. When required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Ether, our users, or others.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this policy or equivalent protections.
Data retention
We retain information for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods may vary by data type. You may contact us to request deletion of your account or personal information where applicable law provides that right. Some information may be retained in backup or log systems for a limited period.
Security
We use reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, or alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us at support@tryether.ai and we will take appropriate steps to delete it.
Your choices and rights
Depending on where you live, you may have rights to access, correct, delete, or restrict certain processing of your personal information. To exercise these rights, contact support@tryether.ai. California residents may have additional rights under applicable state law.
Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this page. Material changes may be communicated through the Service or by other appropriate means. Your continued use after changes become effective constitutes acceptance of the updated policy.
